Terms and Conditions for Quest for Exams

Welcome to Quest for Exams. These Terms and Conditions (the "Terms") govern your use of our website and services, accessible at questforexams.co.uk (the "Website"). By accessing or using our Website, you agree to comply with and be bound by these Terms. If you do not agree with these Terms, please do not use our Website.

1. User Registration and Profiles

1.1 Registration: To access certain features of the Website, parents or guardians must register and create an account. Registration requires the provision of accurate information including your name and email address.

1.2 Child Profile: After completing the initial registration, parents or guardians may add a profile for their child. This profile requires the child’s name (or a nickname, if preferred) and grade level. The option to use a nickname is provided to enhance privacy and create a secure and personalised learning environment.

In addition, parents are required to create a unique user ID for the child, which will enable the child to access their own portal. The parent is responsible for maintaining the confidentiality and security of the user ID and ensuring that it is used in accordance with these Terms.

1.3 Privacy and Security: All personal information collected is used in accordance with our Privacy Policy and applicable data protection laws. We are committed to ensuring the privacy and security of your information.

2. International Data Management

2.1 Data Management: Our data management facilities are located outside the UK. However, we ensure compliance with local and international data protection regulations, including the laws applicable in your country of residence.

2.2 Data Protection: We implement robust security measures to protect personal data from unauthorised access and processing. This includes encryption, secure storage, and access controls.

2.3 Data Use: User data may be used for various purposes, including but not limited to marketing communications, progress tracking, and analytics to improve our services. We ensure that all data usage is conducted transparently and in compliance with applicable data protection laws. User data will only be processed for the purposes for which consent has been obtained, and we are committed to respecting user rights under these laws.

3.2 Opt-Out: Users can opt-out of marketing communications via their account settings while still receiving essential notifications related to their account and child’s educational activities.

4. Accuracy Disclaimer

4.1 Content Accuracy: We strive to provide accurate and high-quality educational materials prepared by experts in the relevant fields. However, due to the human element involved in content creation, errors or omissions may occur. We encourage users to report any discrepancies or errors they encounter, and we are committed to correcting any mistakes promptly to ensure the continuous improvement of our content.

4.2 Supplemental Learning: Our materials are intended as a supplement to traditional learning methods. We disclaim liability for any inaccuracies in content except as required by law.

5. Practice and Mock Exam Methodology

5.1 Mock Exams: Our mock exams are designed to closely simulate real exam conditions and are based on familiarisation papers that help students prepare effectively. While we aim to structure these exams to reflect actual exam formats and difficulty levels, it is important to note that variations may exist. The specific format of an exam can differ depending on the requirements of each school or institution, and our mock exams may not always replicate these exact formats.

5.2 Attempts: Our mock exams allow multiple attempts to encourage thorough and effective preparation. Each mock exam is valid for one year from the date of purchase. If no attempt is made within this one-year period, access to the mock exam will expire, and the user will need to purchase it again to regain access. Attempts are unlimited within the validity period, but once the exam expires, a new purchase is required to continue access.

6. Educational Use Agreement

6.1 Purpose: The Website is for educational purposes only. Misuse, including sharing account details or using the platform for commercial purposes, may result in account suspension.

6.2 Account Security: Users must maintain the confidentiality of their account details and use their accounts solely for personal educational purposes.

6.3 Integrity: Users must respect copyright laws, avoid plagiarism, and engage in honest conduct during assessments.

6.4 Reporting: Users are encouraged to report any misuse or issues to us. Violations may lead to account suspension or termination.

7. Product Expiry and Family Accounts

7.1 Validity: All educational products purchased on the Quest for Exams platform, including study materials, practice papers, and mock exams, are valid for one year from the date of purchase. After this period, access to the purchased products will expire, and all progress data associated with that specific bundle will be removed. Users are advised to review and save any important progress data before the expiry date, as this information cannot be retrieved once the product has expired.

7.2 Family Accounts: Each parent account can create and manage up to two child profiles. Parents can assign purchased educational products to any of their child profiles. To create additional profiles beyond the limit of two, an additional fee will apply based on the number of extra profiles and the extent of access required for each..

8. Analytical Reliability Clause

8.1 Analytics: Performance analytics are based on user engagement and are intended as a guide. The reliability of these analytics depends on accurate usage of the platform.

8.2 Data Retention: Upon expiry of educational products, related analytics and progress data will be removed.

9. Reading Club Operations

Note: The Reading Club feature is currently on hold. We consider it part of our upcoming tasks and will soon provide updates on its status.

9.1 Sessions: The Reading Club hosts sessions twice a week, focusing on public domain story passages to enhance children's reading skills and comprehension. The primary purpose of these sessions is to develop a consistent reading habit and help children understand and interpret texts effectively. No free practice materials will be provided as part of these sessions; all activities and discussions are designed solely to encourage active reading and comprehension in a guided and interactive environment.

9.2 Recordings: Video calls with tutors may be recorded for quality and training purposes. Participants consent to these recordings by participating.

9.3 Content: We do not claim rights to the reading materials used, ensuring that all content is sourced exclusively from public domain materials. Proper attribution is provided to all authors, novels, and related works. The Reading Club is not a subscription-based service but a one-time purchase for a specific period. The purchase will specify the number of classes offered per week. Refunds will not be issued if a child misses or does not attend any classes during the purchased period.

10. Comprehension Content Sourcing

10.1 Passages: We use public domain passages for comprehension exercises. Original questions and answers are created by our team based on these passages.

10.2 Content Ownership: We do not claim rights to the original passages but retain rights to our proprietary educational content.

11. School Information Disclaimer

11.1 Information: We provide descriptive overviews of schools, including details on admission criteria, catchment areas, exam formats, and deadlines, based on publicly available information. While we strive to ensure the accuracy of this information, users are advised to verify details directly with the schools. Due to the fact that dates can vary each year and schools may not always update the information on their websites, there is a possibility of human error. Therefore, Quest for Exams does not guarantee the completeness or current accuracy of all school-related information.

12. School Past Papers Disclaimer

12.1 Past Papers: We provide solved past papers to assist with your preparation. Please note that our charges apply only to the original answers and explanations we provide, not to the publicly available question papers.

Additionally, we offer practice and school proxy papers, which include original content as well as proxies of GL, CSSE, SET board exams, and independent school admission papers. These proxy papers are designed to reflect the style and format of actual exams, though there may be some variations as they are created independently.

12.2 Usage: Users should respect copyright terms for the original question papers and use our solutions as part of broader study efforts.

13. Tutor Profile, Verification, and Material Use

Note: The Tutor Portal feature is currently on hold. We consider it part of our upcoming tasks and will soon provide updates on its status.

13.1 Tutor Portal
Private tutors can sign up and use the Tutor Portal to access and assign our materials to their students. While currently, tutors can only use materials provided by us, in the near future, we aim to introduce an option for tutors to upload their own materials, subject to review.

Tutors are required to pay a fee per child in addition to the cost of the package they select. The package fee covers access to materials and usage based on the selected model. Regardless of the package chosen, the per-child fee applies each time a tutor assigns materials or facilitates a session for a specific child.

Important Clauses for Fee Payment:

  • Non-Refundable Per-Child Fee: The per-child fee is non-refundable, even if the assigned child does not attend or utilise the materials or sessions.

  • Package Selection and Changes: Tutors should carefully choose their package based on their expected usage. Changes to the selected package may be subject to additional fees or restrictions.

  • Fee Liability: Tutors bear full responsibility for all fees associated with their selected package and the per-child usage. Non-payment of these fees will result in restricted access to the Tutor Portal.

13.2 Verification
Tutors must undergo a verification process to ensure safety and credibility. This process requires the submission of the following documents:

  • Proof of Employment: Documentation verifying the tutor's current employment status.

  • DBS Check: A Disclosure and Barring Service (DBS) certificate or equivalent to confirm the tutor’s suitability to work with students and to ensure no misuse occurs on the platform.

By submitting these documents, you give us your consent to collect, process, and securely store your personal data as part of the verification process. Your information will be handled in compliance with applicable data protection laws, and we will only use it for purposes related to your use of the platform. 13.3 Ownership and Use of Materials
All materials provided through our platform are proprietary and must not be copied, shared, or used for purposes other than those explicitly permitted by us. Any misuse, duplication, or unauthorised distribution of our materials is strictly prohibited.

13.4 Content Standards and Moderation
We reserve the right to review and remove any material uploaded by tutors that we deem inappropriate, non-compliant with our standards, or otherwise unsuitable for our platform. Once tutors are allowed to upload their own materials, our decisions regarding the removal of content are final, as this is our website and portal.

13.5 Responsibility for Uploaded Content
Tutors are solely responsible for ensuring the accuracy, originality, and compliance of the content they upload with all legal and ethical standards. We disclaim all responsibility for any issues or disputes arising from a tutor’s uploaded content.

13.6 Subscription Model
Our platform operates on a subscription model with multiple plans and automatic renewal. It is the tutor’s responsibility to manage subscription cancellations. Once a payment is charged, no refunds will be issued, even if the platform is not used during the subscription period.

13.7 Material Accuracy
While we strive to ensure that all our materials are prepared to the highest standards, we do not guarantee error-free content. Tutors are welcome to report any errors they identify, but we assume no liability for such discrepancies.

14. GDPR Compliance

14.1 Data Rights: Users in the EU/UK have rights under GDPR to access, correct, or delete their data. Contact us to exercise these rights.

14.2 Processing: We ensure lawful and fair processing of personal data. Data security measures are in place to protect user information.

14.3 Transfers: Data may be transferred outside the EU/UK under conditions ensuring compliance with data protection laws.

14.4 Children’s Data: We take extra precautions when processing data from users under 13 and obtain parental consent as required.

15. Copyright and Intellectual Property

15.1 Usage: All educational materials provided through our platform are for personal use only. Reproduction, distribution, or any form of unauthorised sharing without our consent is strictly prohibited. Violations of this policy may result in immediate account suspension, removal of access to all materials, and potential termination of the user's account. We reserve the right to take legal action if necessary.

16. Language and Jurisdiction

16.1 Language: All content is provided in English.

16.2 Jurisdiction: Any disputes will be governed by UK law and resolved in UK courts.

17. Delivery of Digital Resources

17.1 Digital Access: All resources are delivered digitally. We do not provide physical shipments.

18. Indemnity

18.1 User Liability: Users agree to indemnify Quest for Exams against claims arising from breaches of these Terms or violations of law.

18.2 Assistance: We may assist in defending claims but retain the right to control defence and settlement.

19. Modifications to Service and Termination

19.1 Modifications: We may modify, suspend, or discontinue any part of the service without notice.

19.2 Termination: We may terminate user access for breaches of these Terms.

20. Payment and Subscription

20.1 Payments: Payments for products and subscriptions are processed securely through Stripe. We do not handle or store any credit card information. All payment details provided during checkout are managed by Stripe, our payment processing partner. We do not retain any of this data ourselves.

20.2 Subscriptions: Currently, we only offer the purchase of products, with no subscriptions available except for on the tutor portal, which is still under discussion. If a subscription service is offered in the future, it will be set up to renew automatically. Users will be able to cancel any subscriptions through their account settings. Please note that no refunds will be provided for unused periods.
